Uttar Pradesh Society Registration Procedures

NGO's are the charitable organization run for the non-profit motive. NGO's are mainly formed for the purpose of advancement of education, culture, to fight against social issues and various other charitable purposes.

There are three types in which a NGO can be established in India:
  1. Society
  2. Trust
  3. Company u/s 25 (Section 8 of Companies Act, 2013)

In this post, I would discuss about the formation of NGO in the form of Society.

In India Societies formation is covered under SOCIETIES REGISTRATION ACT, 1860. This is the most common form of NGO creation and is choosed most amongst all the three form of NGO creation. The relevant portion of the acts covering the type of NGO which can be registered as society is given below:


Charitable societies, the military orphan funds or societies established at the several presidencies of India, societies established for the promotion of science, literature, or the fine arts for instruction, the diffusion of useful knowledge, 1[the diffusion of political education], the foundation or maintenance of libraries or reading-rooms for general use among the members or open to the public or public museums and galleries of paintings and other works of art, collections of natural history, mechanical and philosophical inventions, instruments, or designs.

Steps involved in formation of society differs between states to States as all the States have adopted the above mentioned act with some changes. In this post, I am going to discuss the procedure involved in formation of NGO in the form of Society in Uttar Pradesh.

In Uttar Pradesh, Socities are registered with the Registrar of Firms, Societies and Chit. The detailed procedure is given below:
  1. First get atleast 7 members for formation of a society.
  2. Draft a Memorandum of Association and By-Laws of the society in duplicate with signatures of atleast 3 members on all the papers.
  3. The Memorandum and By-Laws are strictly to be as per the guidelines in Society Registration Act and should be only for charitable purpose.
  4. Take the address proof of all the members of the society and one of the registered address of the society.
  5.  Draft a Board Resolution where all the members had desired to form a society together with a approval of name of the society.
  6. Make a affidavit at Rs. 10 stamp paper saying that the Society name proposed is not used by any other society and the address of the society is correct.
  7. Fees for Society Registration-File all the above documents with a fees of Rs. 2000 (fees is as per January, 2013 but may get revised afterwards).

  2. Hi, Mr Vimal Sajwan. The procedure are more or less same in each state. You are also required 7 members for society registration in Delhi and you would require same documents.

      Yes you can get drafts from the local society registration consultants but please get memorandum prepared as per your society needs as in most of the case drafts provided are not legally and technically sound.

  4. hello sir, is there no other meaning of NGO except of the above said three classes ? as if some1 wants to work for the betterment of nutural environment then can he go through this process ?

    1. Hi Shailendra,
      Legal status of NGO, in India, are only in these 3 forms i.e. Society, Trust and Section 25 Company. NGO can work for betterment of Environment and its is one of the Charitable Object, you can get any registration amongst the three given above.

    I m feeling stuck and need ur help.
    I want to open a NGO with the aim of free Computer Education to the Children in the Rural areas in all UP (First) after that we will increase our span if get success at first level.



    :- Please suggest which type of NGO we should register and how?


    :- This NGO will work in UP and NCR both, so where should we register it?

    1. Hi Abhishek Mittal,

      If you want to work All Over India, you will have to register a National Level Society, Trust or Section 25 company. You cannot register a State Level Society in Uttar Pradesh, if you want to work all over India.


      I would suggest you to open a Section 25 company or National Level NGO due to better regulations.
