HOW TO FILE RETURN WHEN INCOME AND TDS BOTH INFLATED BY COMPANY

QUESTION-
I have done some consultancy work for a company. At the time of filing my return, I saw that company has inflated my income as well as TDS in my form 26AS. What should be the solution, should I claim the extra TDS?


ANSWER-
First of all file a written complain to the company concerned and tell them to revise their TDS return. If company does not do that, show them the provison of penalty as well as prosecutions. Keep the record of communication with the company.

Secondly file your Income Tax retun with your correct details of Income and TDS. Don't ever try to claim extra TDS, you will have to face the penalty and prosecution from Income Tax Department.

Thirdly since your details will not match, IT Department may issue notice to you, don't panic write a simple reply about the problem, with the attachment of Form 16/16A and the communication letter with the company. In no case IT department can penalise you and it will be the company who will face the problem.
