INCOME TAX RETURN HAS TO BE FILED, IF NOTICE RECEIVED FROM INCOME TAX DEPARTMENT

QUESTION-

Hi Sir,
I got a letter from income tax department stating I haven't filed the tax return for the year 2010, 2011 and 2012.
I have been working in India from the year 2007 to 2009 and for that year I had filed the tax return through my company. I moved to US ( after my marriage ) in the year 2011 and I am currently a housewife in US.
How should I deal with this situation? Do I have to file tax return even if I have no income in India for the year 2010 , 2011 and 2012.
Please advise.
ANSWER- 
Hi Renuka,
As per Income Tax Act you have to file your return when your income is above taxable limit excluding any deductions. Thus in your case return filing is not necessary since you don't earn income after your marriage.

But, since you have got a notice from the department asking you to file the return, you will have to file your return even if your income is NIL. Please file your returns as in the case of non-filing a penalty proceeding can be initiated by the Tax Department.
