CA/CS/CMA are allowed to represent before VAT Authorities

After the interference of ICAI in the matter of Tax Lawyers Association & Anr. v/s State of U.P. & Ors. the Hon’ble Lucknow Bench of Allahbad High Court has removed the stay on Non-Advocates to appear before VAT Authorities. The said stay was removed on 20th August, 2014.


Earlier, decision made on 6th of August 2014 a temporary ban has been made on non Advocates to appear before VAT authorities by LUCKNOW BENCH OF THE ALLAHABAD HIGH COURT in the matter of Tax Lawyers Association & Anr. v/s State of U.P. & Ors. This has caused a lot of hardships to other professionals who were allowed by the ACT to represent the dealers. The matter was immediately taken by ICAI and after a long hearing the stay was removed in the favor of Other professionals.

ATTENTION OF MEMBERS

ANNOUNCEMENT ON COURT VERDICT MODIFYING THE STAY ORDER DATED 6 AUGUST 2014, BY THE LUCKNOW BENCH OF THE ALLAHABAD HIGH COURT ON VAT
This is with reference to the order passed by the Lucknow Bench of the Allahabad High Court in the matter of Tax Lawyers Association & Anr. v/s State of U.P. & Ors. whereby only registered advocates were permitted to appear before the Authority under the VAT Act in the State of U.P.

On applications filed by the Institute for impleadment and vacation of stay, the Hon’ble Lucknow Bench of Allahbad High Court has modified its order dated 6th August, 2014 and consequently Chartered Accountants would continue to be permitted to appear before the Authority under the VAT Act in the State of U.P.
